This Order applies sections 731, 733 and 734 of the Income Tax (Trading and Other Income) Act 2005 (c. 5) (periodical payments of personal injury damages etc.) to certain periodical payments to persons infected by HIV through contaminated blood or blood products used by the NHS. The effect of the Order is that no liability to income tax will arise for the recipients of these payments.

The Non-Domestic Rating (Valuation of Utilities) (Scotland) Amendment (No. 2) Order 2010: Executive Note
This Order revokes two earlier orders, which are not yet in force, both amending the Non-Domestic Rating (Valuation of Utilities) (Scotland) Order2005 (“the 2005 Order”). The Non-Domestic Rating (Valuation of Utilities) (Scotland) Amendment Order 2010 (“the 2010 Order”) was made to replace the Non-Domestic Rating (Valuation of Utilities) (Scotland) Amendment Order 2009 (“the 2009 Order”) in order to add three new fixed line operators to the table forming part of article 7A(2) to be inserted into the 2005 Order.

Section 205 of the Finance Act 2004 is amended to increase the limit for the lower rate from £10,800 to £20,000. The upper rate is increased from 40% to 50%. The amendments will take effect for the tax year 2010-11 and subsequent tax years.

The Magistrates’ Courts (Foreign Travel Orders) (Amendment) Rules 2010: Web Version
These Rules amend the Magistrates’ Courts (Foreign Travel Orders) Rules 2004 (S.I. 2004 No.1051) to substitute new forms into Schedules 2 (Summons on application for a Foreign Travel Order) and 3 (Foreign Travel Order) in consequence of amendments to the Sexual Offences Act 2003 made by the Policing and Crime Act 2009 (“the 2009 Act”). The new forms refer to the requirement under the 2009 Act for a person who is subject to a foreign travel order prohibiting travel to all countries outside the UK to surrender his or her passport(s) to the police station within the time limit specified in the order; and reflect that a foreign travel order may now be imposed for a period of up to 5 years.

This Order specifies various bodies as permitted transferees for the purposes of Schedule 7 to the Apprenticeships, Skills, Children and Learning Act 2009. Under that Schedule, the Secretary of State may make a staff transfer scheme and a property transfer scheme to transfer staff and property of the Learning and Skills Council for England to (amongst others) permitted transferees.

The Children’s Trust Board (Relevant Partners) (Exceptions) (England) Regulations 2010: Web Version
Section 12A of the Children Act 2004 requires a children’s services authority (“establishing authority”) in England to establish a Children’s Trust Board (“Board”) for its area as part of the arrangements made under section 10 of that Act. A Board must include a representative of each of the establishing authority’s relevant partners unless they are of a prescribed description. These Regulations prescribe the Strategic Health Authority as such a relevant partner. This has the effect that a Board will not need to include a representative of the Strategic Health Authority on the Board.

The Policing of Aerodromes (Belfast International Airport) Order 2010: Web Version
This Order provides that Belfast International Airport is not a “relevant aerodrome” for the purposes of Part 3 of the Aviation Security Act 1982 and accordingly does not require a police services agreement (specifying levels of policing and funding for policing by the aerodrome manager) and is not subject to the provisions of section 26(1) of the Act (which relate to the powers of constables and members of an aerodrome constabulary).

The Taxation of Pensions Schemes (Rates, etc) Order 2010: Web Version
This Order makes amendments to the rate of two tax charges applicable to pension schemes. The rate specified in section 394 of the Income Tax (Earnings and Pensions) Act 2003 which applies to the charge on “relevant benefits” contained in section 394(2) is increased from 40% to 50%. Section 205 of the Finance Act 2004 is amended to increase the limit for the lower rate from £10,800 to £20,000. The upper rate is increased from 40% to 50%. The amendments will take effect for the tax year 2010-11 and subsequent tax years.

Part 5 of the Local Democracy, Economic Development and Construction Act 2009 establishes a new regional strategy for each region in England, outside Greater London, setting out policies in relation to sustainable economic growth and in relation to development and land use in the region. The regional strategy is kept under review and revised from time to time by the responsible regional authorities (‘RRA), which comprise the Leaders’ Board for the region and the Regional Development Agency. These Regulations set out requirements in relation to revision of the regional strategy by the RRA.
